Terms of use
By registering for and using this program you agree to be bound by these Terms of Use. Kyabra Community Association (KCA) reserves the right to change or modify these terms.
To register as a user of the program you must be 18 years of age or over.
To create a website for a child you must be either the parent or legal guardian of the child or, if you are not, you must have obtained written permission to do so from the parents or guardians of the child.
Once you register, you will be provided with a unique user name and password that gives you access to your own admin page in the program. You are solely responsible for maintaining the security of these log-in details. If you have reason to believe that your log-in details are no longer secure, please contact us and we will provide you with a new password.
To become a registered a user of the program is free. However, payment is required for the websites you establish for children. On your admin page you will find detailed information about pricing and ordering options for establishing websites for children.
Your registration information must be accurate and up-to-date. Failure to provide accurate information may result in suspension or termination of your account in the program.

Acceptable use
You are fully responsible for your use of the program and any children's websites that you create, and any content you post on the children's websites.
You are prohibited from posting (or assisting with the posting) of any communication or content on any child's website that:
- is illegal;
- discloses anyone else's personal information without their consent or otherwise breaches any state or national privacy legislation;
- breaches any third party intellectual property rights;
- is abusive or threatening in anyway;
- is defamatory; or
- is inappropriate due to the nature of the program being targeted at children.
Should it become known to us that there is any prohibited content on any of the children's websites on your account, we may suspend or terminate your account without prior notice.

The children's websites are secure. They can only be accessed by you (the registered user who has established the website to the child), the child's parents/guardians, and the child's invited supporters. The parents/guardians as well as each invited supporter will be provided with a unique username and password.

KCA reserves the right to modify any feature of the program without notice and the right to interrupt the program from time to time if necessary to perform maintenance.

Your personal information is only collected for the purpose of administering your registration. Examples of this administrative use include providing you with a username and password, delivering to you a code containing options for establishing websites, or contacting you for reasons related to your registration or to the websites you have established for children.You can access and change your personal information at any time by opening the "My info"-tab on your home page.
Your personal information is stored on a secure sever which is located in Helsinki Finland. Your personal information can only be accessed by a handful of persons who have been granted administrative access to the program. We will not disclose your personal information to any third parties except in accordance with our legal obligations.

Intellectual Property
You agree not to copy or utilize any content or graphics of the program without acquiring written permission from the owners of the program.
You agree not to develop a program that uses the same idea and logical structure as this program. Any messages or content you place on the child's website will remain your property.

Termination of accounts
We may terminate or suspend your registration in our discretion, including if we find that you have breached these Terms of Use. If you wish to dispute your termination or suspension, please contact us on the details provided below.
You can remove a child's website at any time by clicking the bin icon in the child's listing on your admin page. The removal of a child's website will automatically also lead to the removal of all information pertaining to the child from the system.
If you wish to terminate your own account please contact us and we will delete your account from the system.
Any indemnities given by you and any limitations to our liability survive termination of your registration to the program.

Liability and indemnity
To the extent permitted by law, we (and our affiliates) will not accept liability for any claims or expenses, arising out of your registration and the use of the program, except to the extent that such claims or expenses are caused by negligent conduct on our part or the part of our representatives.
You acknowledge that we are not responsible for any third party content or links to third party websites on the program or the children's websites.

If the whole or any part of a provision of these Terms of Use is void, unenforceable or illegal in a jurisdiction it is severed for this jurisdiction. The remainder of these Terms of Use has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of the Terms of Use or is contrary to public policy.

By using the program, you submit to the jurisdiction of Queensland, Australia and the courts of appeal from this jurisdiction. You waive any right you may have to object to an action being brought in those courts including, without limitation, by claiming that the action has been brought in an inconvenient forum or that those courts do not have jurisdiction.
